Our owners enjoy the beaches, shopping, entertainment, and restaurants of nearby Rehoboth Beach, Dewey Beach & Fenwick Island, Delaware and Ocean City, Maryland. We have access to the best the Eastern Shore has to offer. Major highways provide easy access to Washington, Baltimore, Wilmington, Philadelphia and New Jersey.

Here in The Pointe at Bethany Bay we enjoy peaceful, quiet, off-the-beaten track living with four hundred and twenty acres of lush, unspoiled land. More than half the land will remain in its pristine state, so that future generations can enjoy the bird sanctuaries, sparkling ponds, and protected wetlands as much as our residents do.

Council Update

If you are lucky enough to live by the water, you are lucky enough …

MEMORIAL DAY WEEKEND!  HOW CAN IT BE!  WELCOME SUMMER!
The Pointe Council welcomes everyone back to Bethany Bay.  Listed below are the issues that we have been working with over the winter and spring. 

CONSTRUCTION RELATED -- STAIRWAYS AND SHEDS
We were blessed to have experienced a mild winter with NO reported building envelope leaks from the various storms.   Right now, the only repairs we are making result from roof issues.  Roofs have leaked as a result of faulty original construction and more importantly from faulty repairs over the years.   The Council had a roof inspection.  This inspection disclosed that the roofs generally have many years of useful life left but the prior years’ repairs were of poor quality.  These weakened areas of the roofs and around the dormers are where we have issues.  Right now the plan is to repair as we go while considering a long-term phase plan to replace the roofs with no special assessment.

The Council received reports of stairways literally falling away from the stringers.  The Council immediately moved forward to replace all the stairways.  Looking at the horrific construction of the stairways as they were taken down - we found staples, yes staples, holding the indoor pine wood stairs to the framing.  This is a safety issue that needed immediate attention.  Fortunately, our revised Reserve Study had all the disbursements for the stairways included in 2012 – 2013.  We received two bids and Jim Donato quickly went to work and finished all ten entryways ahead of schedule. Jim also power washed the entryways and sprayed for bugs.

We have received two bids for the shed doors that are comparable to the several bids we received during the first phase of the shed door replacement.  We selected Jim Donato to do this work.  He is going to replace all shed doors that need replacement and all garage doors that need replacement during June through September 2012.  We had hoped that we could just repair certain brick molding, jams, etc., but after careful review of each door, the Council determined that this would be a short term fix that would not solve a long term problem.  The doors have deteriorated to the state where many sheds are leaking because the jams have rotted, the thresholds have weakened, and weather stripping is nonexistent.  Funds will come from Reserves and Operations depending on the Reserve Schedule and estimated useful lives.  Jim can be reached at (302) 858-2264 or sadog58@hotmail.com.

OTHER REPAIRS – LIGHTS, LIGHTS EVERYWHERE Each stairway (15) has 4 light fixtures with 2 light bulbs each for a total 120 light bulbs.  Jim Donato replaced all the lights with high efficiency, long-lasting bulbs and cleaned and/or replaced the light fixtures as best he could.  He also replaced nonfunctioning photo cells.  The Pointe is as bright as it has ever been thanks to Jim.

REWRITE OF DECLARATION AND RULES AND REGS
The Council has spent countless hours reviewing DUCIOA, the Unit Property Act, and our current documents to rewrite these documents in a way that balances the need for a Council to manage an association whereby 95% of the units are vacation related homes with the rights and due process of the unit owners.  We will send the initial draft to the building captains for feedback.  We will incorporate that feedback in a second rewrite, send the revision to an attorney for review, and then circulate this draft to each unit owner.  We will hold a special meeting to review the documents.  The documents require 67% passage by the unit owners and 51% passage (can be negative confirmation) of all mortgage holders.   We hope that this rewrite will encourage other unit owners to step forward to run for Council.

LANDSCAPE UPDATE
Sean McShane has been very busy heading up the Landscape Committee.  Sean oversaw the plantings by the mailboxes and by the corner buildings.  He is currently working with Mr. George Herker on creating a meadow by the pond.  Sean has also agreed to head up the entire BBHOA landscaping committee and worked with Mr. Herker to plant all the gorgeous flowers at the entrance way on Fairway Blvd. to Bethany Bay!  Thank you, Sean!

BETHANY BAY HOA SURVEY
Sean McShane also worked with Larry Foster, secretary of the BBHOA, to develop a survey for every unit owner in Bethany Bay to determine the needs, wants, desires of each unit owner.  The results of this survey will guide the BBHOA in formulating a long range plan to manage and develop Bethany Bay.  The survey is excellent.  It is very important that your voice be heard.  If you did not receive this survey, please contact secretary@bethanybay.org.

DOGS AND DOG WALKERS
We have received numerous complaints that dog walkers are not cleaning up after their pooches and that dog walkers are letting their dogs walk through the new plantings!  Please be considerate and clean up after your dog.  PLEASE DO NOT WALK THROUGH THE NEW FLOWER BEDS!

RENTERS RULES AND COMMUNICATIONS
Bridget Anderson has volunteered to be the chair of the Pointe Rental Committee.  She will work with the BBHOA Rental Committee.   As we all know, certain rentals in Bethany Bay, and specifically in the Pointe, were out of control over the past two years.  We successfully passed and filed a Rules Amendment that prohibits sublets for groups such as TAN.  We believe that these sublets caused 99% of the problems at the Pointe and hope that this summer will be pleasant for our unit owners as well as our renters.  If you have any complaints about renters or questions about policy, please contact Bridget at shantymurphy10@gmail.com.  As you know, BBHOA requires that each unit owner who rents their unit file a rental information form and obtain the correct rental passes. 

FLOTILLA UPDATE
Commodore Bill Carlisle is organizing this summer’s flotilla scheduled for July 14, destination to be determined.  

4TH OF JULY
This year’s 4th of July celebration will be held at Pavilion’s open space on Saturday June 30.  Michele Sylvester has volunteered to be the point person for the Pointe.  More details to follow.

LEGAL ACTIONS
As noted in previous emails, The Pointe Council has been unable to remediate certain mold issues going back to last May 2011 as a result of a unit owner’s failure to address the issue or to allow the Council to address this issue.  As a result, the Pointe Council, through its attorney, will file a Court Action requesting that we be allowed to remediate the mold. 

Also, as noted in previous emails, The Pointe has one unit owner who filed Chapter 7 bankruptcy and has been discharged thereby being absolved of all debts prior to bankruptcy.  However, the post-bankruptcy monthly assessments continue to go unpaid.  The bank involved has not forced foreclosure making it impossible for us to collect these assessments from the bank.  Therefore, we are taking legal action to foreclose on this property as permitted under DUCIOA.  We have also informed the unit owner that they have no common element privileges including parking on Pointe property.  The BBHOA has also removed all recreational privileges and parking on BBHOA common grounds.

Unfortunately, these issues are costing us legal fees, money that would be better spent on roofs and landscaping.  However, in both cases, the Council believes it has no choice other than to take legal action.

LEGUM AND NORMAN – ANGIE HOWELL
The Pointe Council expresses great appreciation to Angie Howell, our property manager, who has done a super terrific job of transitioning us from Wilgus and bringing us into the 21st century.  We have received positive feedback on the LN website particularly with respect to the ability for each unit owner to have his/her own portal for reviewing monthly assessment payments and for corresponding with our property manager.   In addition to unit owners being able to directly view their balances, etc., the Board has a portal whereby we can see every cash receipt and disbursement, the accounts payable balance, bank account balance, and delinquent accounts in real time.  This website has enhanced our financial management.  If you have any questions about these services, please contact Angie Howell at ahowell@legumnorman.com.   If you have not viewed your account on line or gone to the new website, below are the simple steps to do so:
